Terms and Conditions for Gardeners Bethnal Green

Gardening terms and conditions introductionThese Terms and Conditions set out the basis on which gardening services are provided by our team to domestic and commercial customers. By booking any service, you agree to these terms, which are intended to keep the process clear, fair, and straightforward for both parties. Throughout this document, references to gardeners Bethnal Green, Gardeners Bethnal Green, the gardener, the service provider, or we refer to the business carrying out the work, and references to you or the customer refer to the person arranging the service.

These terms apply to a broad range of garden services, including routine maintenance, seasonal tasks, hedge trimming, lawn care, planting, clearance, and related outdoor work. They are designed for use as a legal service page and do not form a guide or advice article. Please read them carefully before making a booking, as they explain the service scope, payment arrangements, cancellation rules, liability limits, and the handling of green waste and other materials removed from site.

Booking and quotation terms for garden servicesBy placing a booking, you confirm that you are legally able to enter into a contract and that you have authority over the property or permission from the property owner or manager to arrange the requested work. If you book on behalf of someone else, you remain responsible for ensuring the accuracy of the information provided and for making sure that the terms are understood and accepted.

Bookings may be made by the methods offered at the time of enquiry, and a booking is only confirmed once the requested details have been reviewed and accepted. We may ask for information such as the service address, type of work required, access arrangements, preferred dates, and any relevant site conditions. For certain jobs, we may provide a quotation based on the information supplied, photographs, or an on-site assessment. Any quotation is usually based on the stated requirements and may be adjusted if the actual work differs from the description provided.

When arranging a visit, you must ensure reasonable access to the property and to the work area. If access is restricted, delayed, or impossible because of circumstances outside our control, the appointment may be rescheduled and additional charges may apply. Where attendance is required at a specific time, we will make reasonable efforts to arrive within the agreed period, but arrival times may be affected by traffic, weather, other jobs, or unforeseen operational issues. We do not guarantee exact arrival times unless expressly agreed in writing.

Payment and cancellation rules for gardening workThe scope of work will be limited to the tasks confirmed at the time of booking or in the written quotation. If you ask for additional work on the day, we may accept, decline, or price that work separately depending on time, equipment, and staffing. Any change to the original instructions may affect the price, duration, and completion date. For larger or more complex services, the work may be completed in stages, and the final outcome may depend on season, plant condition, weather, and site constraints.

Payments must be made in full according to the terms stated at booking or on the invoice. Unless otherwise agreed, payment is due on completion of the service, though some projects may require a deposit or staged payments in advance. Accepted payment methods will be set out before the work begins. If payment is not received on time, we reserve the right to charge reasonable costs incurred in collecting the debt, and where permitted by law, interest may be applied on overdue amounts.

All prices are stated in sterling and may be shown as fixed fees, hourly rates, or estimates. An estimate is not a binding final price unless expressly agreed as such. If the job takes longer than expected because the actual site conditions differ materially from the information provided, the price may be revised to reflect the extra time, labour, equipment use, or disposal requirements. We will normally discuss any significant change before continuing the work, provided that this is reasonably practicable.

Customers are responsible for ensuring that any payment disputes are raised promptly and in good faith. If you believe an invoice is incorrect, you must notify us without delay and provide the reasons for your query. Undisputed amounts remain payable in accordance with the original terms, even where a separate part of the invoice is challenged. Any discounts, promotions, or special rates apply only where expressly stated and may be withdrawn or amended without notice for future bookings.

Waste handling and disposal compliance for gardenersCancellation terms are intended to balance customer flexibility with the time reserved for each booking. If you need to cancel or reschedule, you must provide notice as early as possible. Where reasonable notice is given, we may offer an alternative date without penalty, subject to availability. If cancellation is made at short notice, a charge may apply to cover time reserved, administrative costs, and any preparatory work already completed.

If you fail to provide access, are unavailable at the agreed time, or do not give sufficient notice to cancel, the booking may be treated as a late cancellation or a missed appointment. In such circumstances, we may charge a cancellation fee or the full value of the reserved time, depending on the nature of the service and any losses reasonably suffered. Any prepaid deposit may be retained to the extent necessary to cover these losses, unless a refund is required by law.

We may cancel or postpone a booking where conditions make it unsafe, unlawful, or impracticable to proceed. This includes, without limitation, extreme weather, unsafe garden structures, hidden hazards, equipment failure, or site conditions that materially differ from what was described. In such cases, we will try to offer a revised appointment or suitable alternative. We are not liable for delay or non-performance caused by events outside our reasonable control, including severe weather, transport disruption, or acts of third parties.

Our liability is limited to losses caused by our negligence, breach of contract, or other legal fault, and only to the extent permitted by law. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded. Subject to those mandatory rights, we will not be responsible for indirect, incidental, or consequential losses, including loss of profit, loss of enjoyment, or loss arising from the use of the property after the work is completed.

Garden work can involve natural variation and pre-existing conditions. We are not responsible for hidden defects, underground services, unstable surfaces, pre-existing disease in plants, or damage resulting from defective fixtures, poor prior maintenance, or information withheld by the customer. If you ask us to work close to structures, cables, irrigation systems, walls, or delicate planting, you must tell us of any known risks beforehand. You are also responsible for securing valuables, fragile items, and pets before the service begins.

If damage occurs and is proven to have been caused by our negligence, our responsibility will generally be limited to the reasonable cost of repair or replacement, taking into account depreciation and normal wear and tear. You must notify us of any issue as soon as reasonably possible after the service, and you must allow us a fair opportunity to inspect and, where appropriate, remedy the matter. Failure to report a problem promptly may affect our ability to investigate and may reduce any entitlement to a remedy.

Governing law and liability terms for garden servicesAll waste removed from the property, including grass cuttings, branches, leaves, soil, weeds, and packaging, will be handled in line with applicable UK waste regulations and environmental requirements. Where green waste is collected as part of the service, it may be transported for composting, recycling, or lawful disposal at an approved facility. We will not knowingly dispose of controlled, hazardous, or prohibited materials unless this has been expressly agreed in advance and is lawful to do so.

The customer must inform us before the booking if the site contains any waste that may be classified as hazardous, contaminated, or requiring special handling. This includes, for example, asbestos, chemicals, sharp objects, medical waste, invasive plant material subject to control, or items contaminated by oil, fuel, or other substances. We reserve the right to refuse removal of such materials and may suspend work if we discover them unexpectedly. Any extra cost arising from special handling, permits, or lawful disposal arrangements may be charged to the customer.

You must not ask us to remove household rubbish, builders’ waste, electrical waste, or any other non-garden material unless this has been agreed in writing and is permitted under waste law. If the customer wishes to retain cuttings or other organic matter on site, this must be stated before work starts. Ownership of removed waste passes to us only for the purpose of lawful handling and disposal in accordance with the relevant regulations. Improperly described waste may lead to cancellation, revised pricing, or refusal of service.

Any plant replacement, pruning outcome, lawn treatment, or clearance result will depend on the condition of the existing garden, the season, and the scope of the work approved by you. We do not guarantee that plants will survive, regrow, or respond in a particular way unless a specific written guarantee is given. Because living material is affected by weather, soil health, pests, and prior care, the results of horticultural work are naturally variable. The customer accepts that some outcomes may take time to become visible after the service has been completed.

Where we supply materials, plants, or consumables, they remain subject to availability and any manufacturer or supplier limitations. We do not warrant that any supplied product will be identical to a previous batch or to a sample unless expressly stated. If a substitute is necessary, we will use reasonable care to choose a comparable item. Any instructions you give about colour, size, variety, or finish should be as accurate as possible, but minor differences may occur and will not normally amount to a breach of contract.

These terms may be updated from time to time to reflect changes in law, operational practice, or service structure. The version in force at the time of booking will apply to your service unless a later change is required by law or agreed by both parties. If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. No waiver of any right will be effective unless made in writing and signed by an authorised representative.

This agreement is governed by the laws of England and Wales, and any dispute arising from it will be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer law provides otherwise. If any disagreement arises, both parties should first try to resolve the issue in a practical and reasonable manner. Nothing in these terms affects your statutory rights as a consumer under applicable UK law.

By confirming a booking, you acknowledge that you have read, understood, and accepted these Terms and Conditions for gardeners Bethnal Green services. You also confirm that the information supplied is accurate and that you will take reasonable steps to enable the work to be carried out safely, lawfully, and without unnecessary delay. These terms apply together with any written quotation or booking confirmation, and where there is any inconsistency, the written booking details will take priority to the extent permitted by law.
