By placing a booking, accepting a quotation, or allowing our gardeners to start work at your property, you agree to be bound by these Terms and Conditions.

Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, company, or organisation requesting services from Gardeners Bethnal Green.

Scope of Services

We provide gardening and related services in Bethnal Green and surrounding areas. The exact scope of the Services for each visit or project will be as agreed with you during the booking process or as stated in any quotation or written confirmation.

Our Services may include, but are not limited to, lawn mowing, edging, weeding, pruning, hedge trimming, planting, garden tidy-ups, leaf clearance, waste collection and disposal where agreed, and seasonal garden care. Any tasks that fall outside the usual scope of gardening work, or that require specialist equipment, may be subject to additional charges or separate agreement.

Booking Process

You can request a booking for our Services by contacting us and providing the relevant details about your Property, your requirements, and your preferred dates and times.

We may offer a quotation based on the information you provide, on our hourly rates, or after a visit to assess the Property. Quotations are based on the current condition and size of the garden and any information supplied. If the actual condition of the Property differs significantly from what was described, we reserve the right to adjust the quotation or to charge on a time and materials basis.

A booking is considered provisional until it is confirmed by us. Confirmation may be made verbally or in writing. We reserve the right to refuse or cancel a booking at our discretion, for example if access is not possible, the work requested is unsafe, or the Customer has outstanding unpaid invoices.

Where regular maintenance visits are agreed, we will schedule them in advance. While we make reasonable efforts to attend on the agreed days and times, all appointments are subject to weather conditions, traffic, and other factors beyond our control. We will endeavour to notify you of any significant changes or delays.

Access to the Property

You must ensure that we have clear and safe access to the Property on the agreed date and time. Gates should be unlocked, any access codes provided, and any pets secured away from the working area.

If we are unable to gain access or if the working area is unsafe, we may cancel the visit or wait for a reasonable period. Waiting time or a wasted visit caused by lack of access or safety issues may be charged in full or according to our minimum call-out fee.

Customer Responsibilities

You are responsible for:

Ensuring that the Property is reasonably prepared for the Services, for example by removing personal items, toys, or obstacles from the working area.

Informing us of any particular hazards at the Property, such as unstable structures, hidden cables or pipes, or aggressive animals.

Providing access to water and electricity where reasonably required to perform the Services.

Obtaining any necessary permissions, consents, or approvals from landlords, neighbours, or local authorities for work that may affect boundaries, trees, or communal areas.

We will not be responsible for delays, additional costs, or inability to complete the Services caused by your failure to meet these responsibilities.

Quotations and Pricing

All quotations are estimates based on the information available at the time and are valid for a limited period as stated with the quotation or, if not stated, for 30 days from the date given.

Prices may be given as a fixed price for a specific job or as an hourly or daily rate with an estimated duration. Where the work takes longer due to factors beyond our control, such as extreme overgrowth, unexpected obstacles, or customer requests for additional tasks, we may adjust the final price accordingly.

All prices are exclusive of waste disposal fees unless expressly stated otherwise. Any applicable waste collection and disposal charges will be discussed with you in advance.

Payments and Invoicing

Payment terms will be communicated at the time of booking or quotation. Unless otherwise agreed, payment is due immediately on completion of the Services for one-off jobs, or on the date shown on the invoice for regular or contract work.

We accept various forms of payment as notified to you at the time of booking or invoicing. Cash payments, where accepted, must be made directly to our representative and you should request a receipt for your records.

If payment is not received by the due date, we reserve the right to charge interest on the overdue amount at a reasonable rate and to suspend or cancel further Services until all outstanding sums are paid in full. We may also pass unpaid invoices to a debt collection agency, and you may be responsible for any associated collection costs.

Deposits

For larger projects or work requiring advance purchase of materials, we may require a deposit before starting the Services. The amount of the deposit and the payment schedule will be indicated in the quotation or agreement.

Deposits are generally non-refundable if you cancel the work at short notice or after we have committed to materials or labour, except where required by law or otherwise agreed.

Cancellations and Rescheduling

If you need to cancel or reschedule a booking, you should notify us as early as possible. For most appointments, we ask for at least 24 hours notice. For larger projects or multiple-day bookings, a longer notice period may apply and will be specified in any written agreement.

Where adequate notice is given, we will not usually charge a cancellation fee and will try to offer an alternative date. If you cancel with less than the required notice, we reserve the right to charge a cancellation fee up to the full value of the booked Services, particularly where we are unable to reallocate the time to other work.

We may need to cancel or reschedule a booking due to severe weather, staff illness, vehicle breakdown, or other circumstances beyond our control. In such cases, we will notify you as soon as reasonably possible and will offer to rearrange the appointment. We will not be liable for any loss or inconvenience caused by such cancellations or delays, provided we act reasonably and promptly.

Gardening Work and Limitations

We will carry out the Services with reasonable care and skill and in accordance with accepted standards for gardening work. However, gardening and planting are influenced by environmental conditions beyond our control. We cannot guarantee the survival, growth, or performance of plants, lawns, or seeds once the work is completed and handed over to you.

Unless specifically agreed, we do not provide structural landscaping, building works, major tree surgery, or work at significant height. Where such work is required, we may refer you to specialist contractors.

We reserve the right to refuse to carry out any task that we consider unsafe, unlawful, or inappropriate for our level of expertise or equipment.

Waste Removal and Environmental Regulations

We aim to operate in a responsible manner and in line with relevant waste and environmental regulations. By default, garden waste will be left on site in an agreed area for your own disposal, composting, or use, unless you request waste removal as part of the Services.

If you request us to remove and dispose of green waste or other materials, additional charges will apply to cover collection, transport, and disposal fees. We will inform you of these charges in advance.

We will only remove waste generated by our own work unless otherwise agreed. We will not remove hazardous waste, soil suspected of contamination, or items prohibited under local regulations.

You must not ask us to dispose of waste unlawfully. We do not fly-tip and will not participate in any practice that breaches environmental or waste regulations.

Health and Safety

We take health and safety seriously and will use appropriate tools, equipment, and protective gear for the work undertaken. You agree not to interfere with our equipment or instruct our gardeners to act in a way that could compromise health and safety.

You should keep children and pets away from the working area while the Services are being carried out. We are not liable for any injury or damage caused where you have failed to follow reasonable safety instructions or warnings.

Damage and Liability

We will take reasonable care to avoid damage to your property while performing the Services. You should inform us of any particularly fragile items, underground cables, irrigation systems, or other features that might be at risk.

If accidental damage occurs due to our negligence, you must notify us as soon as possible and, in any event, within a reasonable time after the damage is discovered. We reserve the right to inspect the damage before any repair or replacement is arranged.

Our liability to you for any loss or damage arising out of or in connection with the Services shall be limited to the value of the specific job in question, except where such limitation is not permitted by law. We are not liable for loss of profit, loss of enjoyment, or any indirect or consequential losses.

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.

Complaints and Disputes

If you are dissatisfied with any aspect of our Services, you should raise the issue with us as soon as possible so that we have an opportunity to address your concerns. We may ask for details of the issue and, where appropriate, may revisit the Property to inspect the work.

We will aim to resolve complaints fairly and promptly. Where we agree that the Services were not delivered with reasonable care and skill, we may offer to rectify the work, provide a partial refund, or make another reasonable adjustment, at our discretion and in accordance with your statutory rights.

Force Majeure

We will not be liable for any failure or delay in performing our obligations where such failure or delay results from events or circumstances beyond our reasonable control. These may include, but are not limited to, extreme weather, flooding, drought restrictions, strikes, transport disruptions, accidents, or acts of government or public authorities.

Changes to Terms and Conditions

We may update or amend these Terms and Conditions from time to time to reflect changes in our services, pricing, or legal requirements. The current version will apply to each booking at the time it is made. You are advised to review the latest Terms and Conditions before making a new booking.

Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of our Services, shall be governed by and construed in accordance with the laws of England and Wales.

You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim, except where mandatory provisions of applicable law provide otherwise.

Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or other competent authority, that provision shall be deemed removed and the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms and Conditions, together with any written quotation or specific agreement for Services, constitute the entire agreement between you and Gardeners Bethnal Green in relation to the Services. They supersede any prior agreements, understandings, or representations, whether oral or written.
